transferred in performance of the obligations provided for in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the GDPR).
1. The controller of your personal data processed in connection with the business relationships binding the parties, which may be the conclusion and performance of a contract or sending an offer, or for the purpose of recruitment, is TrokenTech Sp. z o. o. with its registered office at ul. 3. If you did not provide your personal data directly to the Data Controller, your personal data was transferred to the Data Controller by the entity on whose behalf you act or the entity that provided your personal data to the Data Controller, as necessary to conclude and perform a contract with that entity or for the purpose of business transactions between the parties. Your personal data may also be obtained by the Data Controller from other publicly available sources, e.g., databases and registers: CEIDG (Central Registration and Information on Business), KRS (National Court Register). From other sources, the Data Controller collects the following categories of personal data (first name, last name, business name), identification data (NIP (Taxpayer's Identification Number), REGON (National Business Registry Number), and contact details (address, telephone number, email).
4. The legal basis for the processing of personal data is:
a) the consent of the data subject, including the sending of offers and marketing information, processing of job candidate data during future recruitment processes (Article 6 paragraph 1 letter a of the GDPR),
b) the performance of a contract or taking steps at the request of the data subject before entering into a contract (Article 6 paragraph 1 letter b of the GDPR),
c) a legal obligation incumbent on the Data Controller related to specific provisions (Article 6 paragraph 1 letter c of the GDPR),
d) the legitimate interest of the Data Controller, for the purpose of implementing business relationships between the parties or in connection with the establishment, exercise or defence of legal claims (Article 6 paragraph 1 letter f of the GDPR).
5. Your personal data is processed in connection with the content sent (submitted) in the form of an electronic message (i.e., e-mail). Depending on the subject matter of the message, we process your personal data for the following purposes:
a) responding to correspondence received from you, including answers to questions and providing information requested by you, and for the purpose of further handling correspondence with you;
b) resolving the matter you are contacting the Data Controller about;
c) recruiting job candidates;
d) concluding and performing a contract or taking steps prior to its conclusion.
6. Your personal data may also be used for direct marketing purposes or to pursue or defend against claims – within the framework of the Data Controller's legally permitted and legitimate interest.
7. The following categories of personal data will be processed:
a) basic data, such as name and surname, for identification purposes;
b) contact details, to enable contact by post, telephone, or email, i.e., telephone number, company address, or correspondence address;
c) other data, such as position and company details;
d) data on identification numbers for accurate identification purposes;
e) and candidate data required to conduct the recruitment process in accordance with Article 221 §1 of the Labor Code.
8. Personal data will be stored for the period necessary to correspond with you on a given topic, and after that time for the period required by the obligations imposed on the Data Controller by law.
9. Personal data processed for the conclusion and performance of a contract will be stored for the duration of the contract and after its termination for the period required by law, i.e., no longer than 6 years after the end of such cooperation. However, after the expiry of the contract or the end of cooperation, processing will be solely for archival, tax, and claim-seeking purposes.
10. Personal data processed for recruitment purposes will be stored for the duration of the recruitment process and for a period of 6 months from the end of the recruitment process for the purpose of pursuing claims. In the case of consent to future recruitment, for up to 12 months from the data transfer.
11. Personal data processed on the basis of consent will be stored until you withdraw your consent or until the purpose of processing ceases to exist.
12. Personal data may be disclosed to persons authorized by the Data Controller, entities providing services to the Data Controller, including technical and organizational services, email services, as well as to other entities/persons/bodies to the extent and under the terms specified by law.
13. Personal data will not be transferred to a third country/international organization.
14. You have the right to request access to your personal data and the right to rectify it.
15. If your data is processed on the basis of your consent, you have the right to withdraw it. Simply send such information to the following email address: biuro@trockentech.pl . Withdrawal of consent will not affect the lawfulness of processing based on your consent before its withdrawal.
16. In cases specified by law, you have the right to request the deletion of personal data, the restriction of personal data processing, the right to transfer personal data, and the right to object to the processing of personal data.
17. You have the right to lodge a complaint with the supervisory authority responsible for personal data protection if you believe that the Data Controller has violated personal data protection regulations.
18. Personal data will not be used for automated decision-making concerning you, including profiling.
19. Due to the fact that your personal data will be processed by the Data Controller for purposes arising from the legitimate interest of the Data Controller, you have the right to object to the processing of personal data for the above-mentioned purpose for reasons related to your particular situation.
