Regulations of the newsletter of TrokenTech Sp. z o. o
1. General provisions
1.1 These regulations (hereinafter referred to as the "Regulations") define the rules of operation of the newsletter (hereinafter referred to as the "Newsletter") run by TrokenTech sp. z o. o. with KRS number 0000342475 (hereinafter referred to as the "Organizer"), in accordance with applicable provisions of Polish law and Directive (EU) 2019/2161 of the European Parliament and of the Council of 27 November 2019 amending Council Directive 93/13/EEC and Directives 98/6/EC, 2005/29/EC and 2011/83/EU of the European Parliament and of the Council as regards the better enforcement and modernization of Union consumer protection rules (Official Journal of the European Union of 18 December 2019, L 328/7), the so-called Omnibus Directive.
1.2 By subscribing to the Newsletter by performing the actions specified in point 3.1 of these Regulations, the User consents to these Regulations and undertakes to comply with them.
2. Definitions
2.1 Newsletter – a service provided electronically by the Organizer, consisting of sending Users commercial information from the Organizer, which is information intended directly or indirectly to promote the Organizer's goods, services or image in accordance with the Act of 18 July 2002 on the provision of services by electronic means.
2.2 User – a natural person who voluntarily registered for the Newsletter, providing their e-mail address and concluded a Newsletter Service Agreement with the Organizer in accordance with point 3 of these Regulations.
2.3 Customer – a person taking steps to conclude a Newsletter Service Agreement with the Organizer.
2.4 Organizer – TrokenTech Sp. z o.o. with its registered office at ul. Bardzka 60, 50-517 Wrocław.
3. Terms of use of the Newsletter
3.1 The conclusion of the Newsletter Service Agreement and the provision of the Newsletter service is possible after completing the following steps:
a) the Customer provides the Organizer with their electronic mail address (e-mail address) in the Newsletter window available on the trokentech.pl portal;
b) the Customer accepts these Terms and Conditions and the Privacy Policy by checking the checkbox next to the message "I confirm that I have read and accept the Terms and Conditions and the Privacy Policy" when expressing consent:
- to receive commercial information from the Organizer to the provided e-mail address (e-mail address), as well as the processing of the Customer's personal data by the Organizer for the purpose of delivering commercial information,
- to the processing of the Customer's personal data by entities cooperating with the Organizer in the implementation of the Newsletter Service Agreement.
Clicking the "ok" button, - confirmation by clicking on the activation link sent to the e-mail address provided by the Customer.
3.2 The provision of the Newsletter service commences after the conditions specified in paragraph 3.1 above are met, upon confirmation by the Customer by clicking, in accordance with paragraph 3.1 letters c and d of these Regulations, on the activation link sent to the e-mail address provided by the Customer, referred to in paragraph 3.1 letters a and b of these Regulations.
3.3 The Newsletter service is voluntary, free of charge, and unlimited in time, and the User may unsubscribe from the Newsletter service at any time without giving any reason and at no cost. Unsubscription is possible in particular by clicking the deactivation link contained in every e-mail sent to the User as part of the Newsletter service. The User may also unsubscribe from the Newsletter via e-mail by writing to the following e-mail address: biuro@trokentech.pl.
3.4 Unsubscription means the immediate termination of the Newsletter service, i.e. the User stops receiving messages as part of the Newsletter service, and the User's data is deleted from the database of Newsletter recipients.
3.5 All content provided as part of the Newsletter service is protected by the Organizer's copyright.
3.6 The User may submit a complaint about the Newsletter service by sending an email to: biuro@trokentech.pl .
3.7 The complaint should include data identifying the User submitting the complaint, a description of the irregularity, and the complaint request. The deadline for the service to consider the complaint is 14 days. The User will be notified of the complaint's resolution via email.
3.8 Users who are consumers may, in matters concerning the Newsletter service, use out-of-court complaint and redress procedures.
3.9 The Organizer is entitled to make changes to the Regulations. Changes will be announced by publishing the Regulations on the website. Changes to the Regulations come into effect within days of the date of their announcement.
3.10 Information regarding the processing of personal data as part of the provision of the Newsletter service can be found in the Privacy Policy.
3.11 The User will be notified of changes to the Regulations via email sent to the email address they provided.
4. Protection of personal data
4.1 The controller of the User's personal data is the Organizer, i.e. TrokenTech sp. z o. o. with its registered office at ul. Bardzka 60, 50-517 Wrocław (KRS number 0000342475).

4.4 The User's personal data, in the form of an email address, are processed for the purpose of concluding and performing an agreement for the supply of digital content in the form of a Newsletter, indicated in point 3 of these Terms and Conditions as the "Newsletter Service Agreement," pursuant to Article 6 paragraph 1 letter a of the GDPR.
4.5 The User's personal data are also processed for the purpose of operating the Newsletter, including the analysis of statistics related to sent messages.
4.6 After the termination of the Newsletter Service Agreement, the User's personal data will be stored in the Controller's database for archival purposes, in order to potentially defend, establish, or pursue claims related to this Agreement, which constitutes a legitimate interest pursued by the Controller, referred to in Article 6 paragraph 1 letter f of the GDPR. These data will be deleted after the expiry of the limitation period for claims related to the Newsletter Service Agreement or the expiry of the period by which the Controller may be subject to a legally required audit of activities related to the Newsletter.
4.7 The User may unsubscribe from the Newsletter at any time in accordance with point 3.3 of these Terms and Conditions.
4.8 The User's personal data will not be subject to profiling and will not be transferred to a country outside the European Economic Area.
4.9 The User has the following rights:

- the right to request the deletion of personal data
- the right to limit the processing of personal data
- the right to transfer personal data
- the right to object to further processing of personal data
- the right not to be subject to fully automated personal data processing operations
